Welcome to Lull. These Terms of Service ("Terms") govern your use of the Lull mobile application ("App"), developed and operated by Korchix ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

Lull offers the following Premium subscription options:
Prices are subject to change. Price changes will not affect existing subscriptions until renewal.
We offer a 7-day free trial for new subscribers. You will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel at least 24 hours before the trial ends.
Important: Monthly and Yearly subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your payment method will be charged for renewal within 24 hours prior to the end of the current period.

We do not store or have access to your payment information. All billing inquiries and disputes must be directed to Apple or Google.
You may cancel your subscription at any time through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until the end of your paid period. No refunds will be provided for partial subscription periods.
All purchases are final and non-refundable, except as required by law or as determined by Apple/Google. For refund requests, contact Apple or Google directly:
IMPORTANT: Lull is a wellness and entertainment application. It is NOT a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition, disease, or sleep disorder.
If you or your baby experience persistent sleep problems, breathing difficulties, excessive fussiness, or any other health concerns, always consult a qualified pediatrician or healthcare provider immediately. Do not rely on this App as a substitute for professional medical advice.
WARNING: Prolonged exposure to loud sounds can cause permanent hearing damage, especially in infants and young children. Always:
The American Academy of Pediatrics (AAP) recommends that white noise machines for infants should not exceed 50 decibels and should be placed at least 7 feet away from the crib.
This App is a tool to assist with relaxation and sleep. It is not a replacement for parental supervision or care. Always monitor your baby and remain attentive to their needs.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control for personal, non-commercial purposes only.

All content in the App, including but not limited to audio files, sounds, sound mixes, graphics, logos, text, software code, and user interface designs, are owned by Korchix or our licensors and are protected by international copyright, trademark, and intellectual property laws.
Certain icons and graphical elements used in the App are licensed from third-party sources, including:
We do not claim ownership of these third-party assets. All rights to these materials remain with their respective owners.
"Lull," the Lull logo, and "Korchix" are trademarks of Korchix. You may not use these trademarks without our prior written permission.
The App currently does not support user-generated content or uploads. If this feature is added in the future, separate terms will apply.
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our data practices as described in the Privacy Policy.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KORCHIX SHALL NOT BE LIABLE FOR ANY:
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR SUBSCRIPTION IN THE 12 MONTHS PRIOR TO THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless Korchix, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
You may stop using the App and cancel your subscription at any time. To cancel, follow the instructions in Section 2.5 (Cancellation).
We reserve the right to suspend or terminate your access to the App at any time, without notice, if:
No refunds will be provided if your account is terminated for violations of these Terms.
Upon termination, your license to use the App will immediately cease. You must delete the App from all devices. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will remain in effect.
We may update these Terms from time to time to reflect changes in our practices, legal requirements, or App features. When we make material changes, we will:
Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the App and cancel your subscription.

For disputes related to subscriptions, payments, refunds, or billing issues, please contact Apple (iOS) or Google (Android) directly, as they are the merchant of record for all transactions. We do not process payments directly and cannot issue refunds.
Any disputes not related to payments shall be resolved in accordance with the laws applicable to your location and in the competent courts of your jurisdiction. We encourage you to reach out to us directly before pursuing legal action, as most issues can be resolved quickly through communication.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Korchix regarding the App and supersede any prior agreements.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
We will not be liable for any delay or failure to perform due to events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, or technical failures.
